Man fined for harassing bowhunter

WEST UNION, Iowa (AP) - A man from rural Fayette County accused of harassing a bow hunter last fall has accepted a plea agreement to settle his legal problems.

Authorities said Wednesday that 44-year-old Brian Gibson paid $506 in fines and court costs stemming from the alleged harassment.

The Iowa Department of Natural Resources complained that Gibson had twice fired a rifle in the bowhunter’s direction while the man was in a tree stand. Gibson was also accused of urinating and spitting tobacco juice on the tree.

The tree was not on Gibson’s land.

Last month, Judge Margaret Lingreen dismissed two counts of assault or display of a weapon, which is an aggravated misdemeanor. She ordered a deferred judgment and six months of self-probation for reckless use of a firearm, which is a simple misdemeanor.

I wonder if the judge would have been so lenient if the bowhunter had been a non-resident hunter who had spent big bucks in coming to Iowa to hunt.  $500 doesn’t seem like much of a fine for shooting twice at a bowhunter in a tree with a rifle.  As for spitting tobacco juice on a tree and urinating on a tree that was not on your own property, there is a question of trespassing, unless it was on public land, in which case spitting tobacco juice could be construed as poisoning, it being nicotine and all.  I would have given him $1,500 fine and two months in jail, then the S.O.B. would have had time to think about his actions.  I also would have taken away his hunting privileges for about a year for the rifle violation.

I bet the guy was a fence sitter. A guy that is spitting tobacco and has a rifle probably is not a tree hugger.
